Terms of Use

1. Agreement and incorporated policies

These Terms of Use (“Terms”) govern the SceneGo mobile application, websites, software, project-discovery tools, creator and producer profiles, screenplay-access tools, messaging, moderation systems, and related services (collectively, the “Service”). “SceneGo,” “we,” “us,” and “our” mean the owner and operator of the Service. “You” means each person who accesses or uses the Service.

By creating an account, selecting “I agree,” accessing, or using the Service, you represent that you have read, understood, and agree to these Terms, the Privacy Policy, Community Standards, Copyright Policy, and any feature-specific terms presented to you. If you do not agree, do not use the Service.

We may update these Terms to reflect changes in law, technology, business practices, or the Service. Material changes will be communicated by reasonable means and, when required, we will request renewed consent.

2. Eligibility and authority

You must be at least thirteen (13) years old to create or use a SceneGo account. If you are under the age of legal majority where you live, you may use the Service only with the review, permission, and supervision of a parent or legal guardian who agrees to these Terms on your behalf. The Service is not directed to children under thirteen. We may request reasonable information to verify age, identity, professional status, or authority.

Members under eighteen must use particular care when communicating or arranging professional opportunities. Do not share a home address, school schedule, financial information, government identifier, or other highly sensitive information. A parent or legal guardian should be involved before an in-person meeting, audition, contract, payment, travel arrangement, or transfer of creative rights.

If you use the Service for a company, production entity, school, agency, or other organization, you represent that you are authorized to bind that organization. You remain individually responsible for activity performed through your credentials.

3. Accounts and account modes

You must provide accurate, current, and complete information and keep it updated. You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly if you suspect unauthorized access.

SceneGo permits Artist and Producer modes under one user account. A Producer profile identifies only producer functions; selecting an account mode does not constitute professional verification, accreditation, employment, agency, financing capacity, or endorsement by SceneGo.

You may not impersonate another person, create deceptive accounts, misstate credits or funding capacity, evade enforcement, sell or transfer an account, scrape account data, or use another member’s credentials.

4. Nature of the platform; no agency or financing guarantee

SceneGo is a technology platform for discovery and communication. SceneGo is not a talent agency, literary agency, employer, producer, lender, broker, escrow service, casting office, law firm, or party to agreements between members.

We do not promise that a project will be read, optioned, purchased, produced, financed, distributed, staffed, or successful; that a member will respond; or that any profile, identity, credit, budget, representation, financing capacity, or opportunity is accurate or legitimate. Members must conduct their own diligence and obtain appropriate legal, financial, tax, insurance, guild, labor, and professional advice.

No listing, profile, access approval, message, badge, ranking, recommendation, or moderation decision is an endorsement. SceneGo has no authority to bind a member and is not responsible for negotiations, meetings, auditions, engagements, contracts, payments, working conditions, intellectual-property clearances, or project outcomes.

5. User content and ownership

“User Content” includes profiles, biographies, credits, photographs, links, loglines, synopses, project details, screenplay files, messages, reports, and other material submitted through the Service. As between you and SceneGo, you retain ownership of your User Content. SceneGo does not acquire ownership of your screenplay merely because it is uploaded.

You grant SceneGo a worldwide, non-exclusive, royalty-free, limited license to host, store, reproduce, format, transmit, display, secure, moderate, and otherwise process User Content only as reasonably necessary to operate, improve, protect, and provide the Service, comply with your settings and instructions, enforce our policies, and satisfy legal obligations. This license ends when the content is deleted except for limited backups, legal retention, safety records, and content lawfully retained by recipients.

You represent and warrant that you own or control all rights necessary to submit User Content; the content is accurate and lawful; and our permitted processing will not infringe copyright, trademark, privacy, publicity, confidentiality, contractual, guild, or other rights. Do not upload material subject to a confidentiality, submission, employment, collaboration, option, shopping, representation, or nondisclosure agreement unless you have authority to do so.

6. Screenplays, confidentiality, and access controls

A screenplay upload is private unless and until you choose to publish project information or grant screenplay access. Public project fields—including a title, logline, synopsis, genre, format, budget range, creator identity, and other information you elect to disclose—may be visible to eligible members and should not contain information you wish to keep secret.

Access controls reduce casual exposure but cannot eliminate copying, screenshots, photography, transcription, memorization, device compromise, unauthorized sharing, or independent creation. SceneGo does not guarantee confidentiality, trade-secret status, copyright registration, non-infringement, or prevention of theft. Uploading does not register a work with the U.S. Copyright Office or any guild.

A recipient may use an accessed screenplay solely to evaluate a potential professional relationship or transaction, may not redistribute or exploit it without authorization, and must honor any separate agreement with the owner. Access approval alone does not create an option, license, shopping agreement, confidentiality agreement, fiduciary duty, submission release, producer attachment, employment relationship, or obligation to negotiate.

Creators are responsible for determining what to disclose, maintaining independent copies, documenting authorship, and using separate written agreements where confidentiality or commercial rights matter. SceneGo may revoke or suspend access to protect users or the Service, but cannot retrieve copies already lawfully or unlawfully made outside its systems.

7. Communications and professional interactions

Messaging is provided for professional communication. Messages are not end-to-end encrypted. Messages reported by a participant may be reviewed for safety and policy enforcement and may also be accessed when required for technical support or legal compliance.

Do not request or send unlawful payments, advance fees for auditions or jobs, banking credentials, government identifiers, passwords, explicit material, threats, harassment, discriminatory content, deceptive offers, malware, spam, or unauthorized promotional communications. Use caution before meeting, sharing sensitive information, transferring money, or entering an agreement.

You are responsible for your interactions with other members. SceneGo may provide blocking and reporting tools but cannot perform background checks on every user, monitor every exchange, guarantee another person’s conduct, or ensure the safety of in-person meetings.

8. Prohibited conduct

You may not violate law or another person’s rights; infringe or misappropriate intellectual property; upload stolen or unauthorized scripts; disclose confidential material; harass, stalk, threaten, exploit, discriminate against, or defraud anyone; facilitate unsafe or illegal productions; solicit sexual services; traffic persons; or promote violence or self-harm.

You may not bypass screenplay protections, probe or disrupt the Service, introduce malicious code, reverse engineer except where law prohibits restriction, scrape or harvest data, train models on User Content without authorization, use automated accounts, manipulate rankings or engagement, make false reports, evade a block or suspension, or use the Service to build a competing database.

You may not use another member’s identity, image, screenplay, project information, or contact details outside the purpose for which access was provided. Professional disagreement alone is not misconduct, but coercion, retaliation, deceptive pressure, and misuse of private information are prohibited.

9. Moderation, enforcement, and preservation

SceneGo uses narrow automated checks on direct text messages to restrict explicit threats, direct payment or audition-fee demands, sexual solicitation, and repeated-link spam. These checks do not scan screenplay files or project descriptions. We also use user reports, blocks, account and content records, preserved evidence, and human review to investigate suspected violations. We reserve the right, but do not undertake a general obligation, to review, restrict, remove, preserve, or disclose content; limit messaging or screenplay access; issue warnings; suspend or terminate accounts; and refer matters to appropriate authorities.

Enforcement decisions involve judgment and may not be error-free. We may act without advance notice when reasonably necessary for safety, security, legal compliance, evidence preservation, or protection of the Service. You may use any appeal process we make available, but submitting an appeal does not stay enforcement.

Reports and related records may be preserved after content or account deletion when reasonably necessary to investigate misconduct, protect users, establish or defend claims, prevent repeat abuse, or comply with law.

10. Payments between members

SceneGo does not currently charge members or offer paid digital features. SceneGo is not an escrow service and does not process project financing, talent compensation, option payments, or production budgets.

You remain responsible for contracts, taxes, and financial obligations arising from transactions you arrange independently with other members. Never treat a SceneGo profile or message as proof of funds.

11. Third-party services

The Service links to IMDb and relies on infrastructure and distribution providers including Supabase, Expo, Apple, and Resend. Those services are governed by their own terms and privacy practices. SceneGo does not control third-party content and is not responsible for its availability, accuracy, security, or conduct.

12. Intellectual property of the Service

Except for User Content, the Service and its software, design, interfaces, text, graphics, databases, selection, arrangement, and branding are owned by or licensed to SceneGo and protected by applicable law. Subject to these Terms, SceneGo grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to use the Service for its intended purpose.

No right to SceneGo’s name, marks, source code, data compilation, or proprietary systems is granted. Feedback may be used without restriction or compensation, provided we do not identify you publicly without permission.

13. Copyright complaints

SceneGo responds to sufficiently detailed notices of claimed copyright infringement and may remove or disable access to disputed material. Our Copyright Policy explains notice, counter-notice, and repeat-infringer procedures. Knowingly material misrepresentations may create liability under applicable law.

14. Suspension, termination, and account deletion

You may stop using the Service at any time and may initiate account deletion from Settings. We may suspend or terminate access for violations, legal risk, fraud, prolonged inactivity, discontinuation of the Service, or protection of users and systems.

Deletion is intended to remove the account and associated User Content, subject to reasonable processing time and limited retention for backups, security, fraud prevention, moderation, disputes, legal obligations, and content that another party is independently entitled or required to retain. Termination does not undo transactions or agreements between members.

Provisions that by their nature should survive—including ownership, confidentiality limitations, disclaimers, liability limitations, indemnity, dispute terms, and records retention—survive termination.

15. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” SCENEGO DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, ACCURACY, SECURITY, AVAILABILITY, AND WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

SCENEGO DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE; THAT USER CONTENT, SCREENPLAYS, MESSAGES, IDENTITIES, CREDITS, FUNDING CLAIMS, OR OPPORTUNITIES ARE AUTHENTIC OR SAFE; OR THAT CONTENT WILL NOT BE LOST, COPIED, DISCLOSED, OR MISUSED. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME MAY NOT APPLY TO YOU.

16. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCENEGO AND ITS OWNERS, AFFILIATES, PERSONNEL, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS, OPPORTUNITIES, DATA, GOODWILL, OR PRODUCTION VALUE; PERSONAL INJURY; INTELLECTUAL-PROPERTY MISUSE; OR DAMAGES ARISING FROM ANOTHER USER, EVEN IF ADVISED OF THE POSSIBILITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCENEGO’S AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID SCENEGO DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR (B) ONE HUNDRED U.S. DOLLARS (US $100). THESE LIMITATIONS DO NOT APPLY WHERE PROHIBITED OR TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED.

17. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless SceneGo and its owners, affiliates, personnel, contractors, and service providers from claims, liabilities, damages, judgments, losses, and reasonable legal fees arising from your User Content; your conduct or transactions with another person; your breach of these Terms; or your violation of law or third-party rights. SceneGo may control the defense of a covered matter, and you agree to cooperate.

18. Disputes and governing law

Before filing a claim, you and SceneGo agree to attempt informal resolution for at least thirty (30) days after written notice describing the dispute and requested relief. This requirement does not prevent either party from seeking urgent injunctive relief or using an eligible small-claims court.

These Terms are governed by California law, without regard to conflict-of-laws rules, except where federal law or non-waivable local law applies. Unless the parties later adopt a separately reviewed arbitration agreement, disputes will be brought in state or federal courts located in Los Angeles County, California, and each party consents to jurisdiction and venue there.

Nothing in these Terms waives consumer rights that cannot lawfully be waived. If a provision is unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will continue.

19. General terms and contact

These Terms and incorporated policies are the entire agreement regarding the Service and supersede prior statements about the same subject. No waiver is continuing. You may not assign these Terms without consent; SceneGo may assign them in connection with a reorganization, financing, merger, acquisition, or transfer of the Service.
